Web Hosting Policy

1. Overview

This Web Hosting Policy outlines the terms and conditions under which Forty Miles West ("FMW", "we", "us") provides managed web hosting services. By subscribing to our hosting services, you ("the Client") agree to these terms.

2. Service Description

Our managed hosting service includes:

  • High-performance cloud server hosting (VPS or dedicated, as agreed)
  • Server-level caching and performance optimisation
  • SSL certificate provisioning and renewal
  • Daily automated backups with 30-day retention
  • Server security monitoring and hardening
  • Uptime monitoring with incident alerts
  • Software updates and patching (operating system, web server, PHP/Node.js)
  • CDN integration via Cloudflare (where applicable)

3. Uptime Guarantee

  • We target 99.9% uptime on a monthly basis, excluding scheduled maintenance windows.
  • Scheduled maintenance will be communicated at least 48 hours in advance where possible.
  • In the event of downtime exceeding the 99.9% target, the Client may request a pro-rata credit for the affected period.

4. Backups

  • Daily automated backups are performed for all hosted sites.
  • Backups are retained for 30 days on a rolling basis.
  • Backup restoration is included in the service at no additional cost. Requests will be actioned within one business day.
  • While we take all reasonable precautions, we recommend that Clients also maintain their own independent backups. FMW is not liable for data loss beyond the scope of our backup systems.

5. Security

  • Server-level firewalls and intrusion detection systems are maintained at all times.
  • Malware scanning is performed regularly across all hosted sites.
  • In the event of a security breach, we will notify the affected Client within 24 hours and take immediate action to contain and remediate the issue.
  • Clients are responsible for maintaining strong passwords, keeping their CMS and plugins up to date (where self-managed), and reporting any suspicious activity promptly.

6. Acceptable Use

Our hosting services must not be used for:

  • Hosting illegal content or facilitating illegal activities
  • Distributing malware, phishing content, or spam
  • Hosting content that infringes intellectual property rights
  • Hosting adult content, hate speech, or content promoting violence
  • Running cryptocurrency mining or other resource-intensive processes without prior agreement
  • Activities that jeopardise the security or performance of shared infrastructure

FMW reserves the right to suspend or terminate services immediately if a Client is found to be in breach of this acceptable use policy.

7. Resource Limits

  • Hosting plans include defined resource allocations (storage, bandwidth, CPU, memory) as specified in the Client's service agreement.
  • If a site consistently exceeds its resource allocation, we will notify the Client and work with them to optimise performance or upgrade their plan.
  • Temporary traffic spikes (e.g., viral content) are accommodated where possible, but sustained overuse may require a plan upgrade.

8. Payment and Billing

  • Hosting fees are billed monthly or annually, as agreed in the service contract.
  • Payment is due within 14 days of invoice.
  • Overdue accounts may result in service suspension after a 7-day grace period and written notice.
  • Fees may be adjusted annually. Clients will be given at least 30 days' notice of any price changes.

9. Support

  • Hosting support is available Monday to Friday, 9:00 AM to 5:30 PM (UK time).
  • Critical issues (site down, security breach) will be addressed outside of normal hours on a best-effort basis.
  • Support requests should be submitted via email to [email protected].
  • We aim to respond to all support requests within 4 business hours.

10. Data Protection

  • All hosted data is processed in accordance with the UK GDPR and the Data Protection Act 2018.
  • Server locations are within the UK or EU, unless otherwise agreed.
  • Upon termination of hosting services, the Client's data will be retained for 30 days to allow for migration, after which it will be securely deleted.

11. Termination

  • Either party may terminate the hosting agreement by providing 30 days' written notice.
  • FMW may terminate immediately in cases of acceptable use policy violations, non-payment beyond the grace period, or illegal activity.
  • Upon termination, the Client is entitled to a full copy of their website files and database, which will be provided within 5 business days of request.

12. Limitation of Liability

  • FMW's total liability under this policy shall not exceed the total hosting fees paid by the Client in the 12 months preceding any claim.
  • FMW is not liable for losses arising from events beyond our reasonable control, including but not limited to upstream provider outages, natural disasters, or cyberattacks.
  • FMW is not liable for indirect or consequential losses, including loss of revenue, data, or business opportunities.

13. Governing Law

This policy is governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
